About The Case
On June 2, 1986, Tyrone Cook was robbed at a subway station in Philadelphia and sustained serious head injuries, from which he later died. Andre Howard was convicted for the crime, primarily based on eyewitness testimony.
The prosecution presented three eyewitnesses, but their accounts had inconsistencies. For example, one eyewitness, Earlene Wright, initially described the perpetrator and even made a photo identification of Howard, but then picked out a different person, Markus Kilkrady, at a lineup where Howard was present. Another witness, William Burton, who worked for SEPTA, initially could not identify the perpetrator from photographs but later identified Howard at a lineup. A third eyewitness, Eva Littlejohn, identified a different person, Larry Green, on the day of the incident, stating “no doubt in my mind it was him”. She later identified Howard from a photo array but did not pick anyone out at a lineup.
The defense case attempted to establish a case of false identity. Two defense witnesses, Wanik Walker and Suad Islam, who were also at the scene, testified that Andre Howard was not the perpetrator. Walker stated there was “no doubt” in her mind that Howard was not the man. The document notes a lack of physical evidence, as the forensic investigator did not collect any fingerprints or blood from the scene. Additionally, a police officer testified that he was looking for a “look-alike” suspect, Horace/Clarence Archer, for similar crimes in the area. The summary concludes that there was not sufficient evidence to convict Mr. Howard due to the inconsistent eyewitness accounts, the lack of initial identification by witnesses, and the fact that two witnesses were sure he was not the perpetrator. It suggests that re-interviewing witnesses could lead to new evidence.
